Private ferry operator Waterway, which oversees Pier 36 in Lower Manhattan, issued an ultimatum to boat operators last week: Ban ticket sellers pushing bogus tours by Aug. 21 or their docking licenses will be revoked.

“The situation created by street vendors in Lower Manhattan has become intolerable for tourists, residents and workers alike,” Donald Liloia, senior vice president of Waterway, wrote to those who organize boat trips to the area.
Statue Cruises is the only operator allowed to take visitors to Lady Liberty and Ellis Island. Tickets are $18.50 and can be purchased online or at the Battery Park kiosk. But sellers who claim to sell tickets for the iconic attraction often trick tourists into buying rides that cruise past those islands, but not to them. Aggressive vendors have long plagued Lower Manhattan’s waterfront, despite efforts by city lawmakers and police to crack down on them.
“We have decided to do our part to help the city solve the problem by no longer allowing an operation that accepts tickets sold by street vendors to access the DockC location,” Liloia’s message continued operators through.
The City’s Economic Development Corporation (CEDC) oversees Pier 36 through its DockC program, which is managed by Billybey, a subsidiary of Port Imperial doing business as Waterway. As of Wednesday, the EDC has already ordered Billbey to notify the ship’s operator, Queen of Hearts, that its license will be revoked in 30 days due to the company’s continued use of street ticket sellers.

“CEDC reserves the right to manage its public docks in a manner that promotes public safety and the goals of the DockC program,” said CEDC spokeswoman Stephanie Baez. “CEDC has received repeated reports that third-party ticket sellers have engaged in sales-inflating practices by aggressively or falsely promoting Statue of Liberty tours.”
To address misconduct, the city council passed a 2016 law that requires ticket sellers to sell boat and bus tours that are registered with the Department of Consumer and Worker Protection (DCWP) and display licenses when operating – a measure that is intended to help law enforcement go. for repeated bad actors. Now, the rule proposed by the DCWP would also require ticket sellers to clearly state on the tickets whether their ship will actually dock at Liberty and Ellis Islands.
Lower Manhattan Councilwoman Margaret Chin, who co-sponsored legislation requiring vendors to register with the city, plans to introduce legislation to codify the proposed rule and is exploring other steps, including possibly banning ticket vendors from to be sold at busy entry points in the neighborhood, such as the subway railways. stations and the designation of kiosks where tickets can be sold, Chin’s office said.
“The chaos we’ve seen and the nightmare stories we’ve heard point to the urgent need for all stakeholders to come together to strengthen enforcement,” Chin said in a statement. “As we work on long-term legislative solutions to fill the implementation gaps, I’m glad DockC and [DCWP] are also stepping up.”

Chin’s legislative efforts are being applauded by neighborhood groups that have long pushed for stricter regulations on ticket sellers.
“This problem has only grown over the years. It’s not sustainable and it’s not the look we want for the millions of tourists who visit and the people who live and work downtown, “said Jessica Lappin, president of the Downtown Alliance, which manages the area’s Business Improvement District. “It’s no longer a nuisance, it’s a safety issue.”
In some cases, ticket sellers became violent, attacked tourists or fought among themselves. Waterway says it will allow those with “legitimate relationships with travel companies” who can present “verifiable contracts” and proof of scheduled departure.
